Terms of Service

Last updated: September 12, 2026. Effective: September 12, 2026.

1. Acceptance of these Terms

These Terms of Service (the “Terms”) form a binding agreement between you and Hermes Media (“Hermes Media”, “we”, “us”) governing your access to and use of the website at hermesmedia.org and of Hermes Media Publisher (together, the “Service”). By accessing the Service, or by connecting a third-party account to it, you accept these Terms in full. If you do not accept them, do not use the Service.

2. Who we are

Hermes Media is an independent editorial publication covering cinema, celebrity culture, style and entertainment. It is published by a natural person acting in an individual capacity and established in France. It is not incorporated as a company and is not affiliated with, endorsed by or sponsored by any studio, platform, publisher or brand mentioned in its coverage.

Contact: [email protected]. We aim to answer written requests within thirty (30) days.

3. Eligibility

You must be at least sixteen (16) years old to browse the Service. You must be at least eighteen (18) years old, and have the legal capacity to enter into a contract, to connect a third-party account or to use Hermes Media Publisher. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

4. The Service

The website provides editorial articles, dossiers and social video pages prepared for commentary, reporting and cultural analysis. Hermes Media Publisher is a web-based publishing workflow used to prepare short-form editorial videos and submit them to a social account that the account holder has connected.

The Service is provided free of charge. We do not currently charge fees for access, and no payment details are collected through the Service. We may add, modify, suspend or discontinue any part of the Service at any time.

5. Connecting a third-party account

Where the Service offers a connection to a third-party platform such as TikTok, the connection is established only through that platform’s official authorisation flow, and only with the permissions (scopes) displayed to you at the moment you authorise it. We request the minimum permissions required to prepare and submit a video on your behalf.

Before anything is published, the connected account holder reviews the prepared video, confirms the caption and the visibility setting, and starts the publishing action. Nothing is posted automatically without that confirmation.

By authenticating and connecting your TikTok account to Hermes Media Publisher, you explicitly agree to comply with the TikTok Terms of Service and the TikTok Privacy Policy, which govern your account and your use of that platform independently of these Terms.

You may revoke the connection at any time, either from the settings of the third-party platform or by writing to [email protected]. Revocation takes effect immediately and prevents any further publication; it does not remove content already published on that platform, which you remain free to delete there.

Access tokens are stored only for as long as the connection is active and are used solely to operate the publishing flow you authorised. They are never sold, rented or shared with third parties.

6. Your content and the licence you grant

You keep ownership of any content you submit, upload or make available through the Service (“Your Content”). You grant Hermes Media a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, reformat and transmit Your Content strictly for the purpose of operating the Service and carrying out the publication you requested. This licence ends when Your Content is removed or when the connection is revoked, except where retention is required by law.

You represent and warrant that you hold all rights necessary to grant this licence, that Your Content does not infringe any third-party right, and that its publication does not breach any law or any rule of the platform on which it is published.

7. Acceptable use

You agree not to use the Service to:

When publishing to a connected platform, you must also comply with that platform’s own terms and content rules — including, for TikTok, the TikTok Terms of Service and the TikTok Community Guidelines. Those rules apply in addition to these Terms, and the stricter rule prevails.

8. Editorial content and accuracy

Articles and dossiers are prepared for commentary, reporting and cultural analysis. They may summarise public events, quote or cite external coverage and link to third-party sources for context. We take care with sourcing, but we do not warrant that any article is complete, current or free of error. Nothing on the Service constitutes legal, financial, medical or professional advice.

If you believe an article contains a factual error, or infringes a right you hold, write to [email protected] identifying the page and the disputed element. We examine every such request and correct or remove content where the claim is founded.

9. Intellectual property

The Hermes Media name, visual identity, editorial writing, page layouts and original media assets are protected and belong to Hermes Media unless stated otherwise. You may quote and link to our articles with attribution; you may not reproduce them in full, resell them, or use them to train a model without prior written permission.

Third-party names, marks, images and excerpts remain the property of their respective owners and are used for identification, commentary, criticism and reporting.

10. Third-party services and links

The Service links to and interoperates with third-party services, including social platforms, media sources and advertising partners. Those services operate under their own terms and privacy policies — for TikTok, the TikTok Terms of Service and the TikTok Privacy Policy, which you accept directly with that platform. We do not control and are not responsible for their content, availability, moderation or distribution decisions, including a platform’s decision to restrict, remove or refuse content submitted through the Service.

11. Suspension and termination

You may stop using the Service at any time and disconnect any connected account as described in section 5. We may suspend or terminate your access, with or without notice, if you breach these Terms, if your use exposes Hermes Media or a third party to legal risk, or if a connected platform requires it. On termination, sections 6 (as to the licence for content already lawfully published), 9, 12, 13, 14 and 17 survive.

12. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, that a publication submitted through it will be accepted by a third-party platform, or that any defect will be corrected. Nothing in this section limits any warranty that cannot be excluded under the law applicable to you, in particular the statutory guarantees available to consumers.

13. Limitation of liability

To the fullest extent permitted by law, Hermes Media shall not be liable for any indirect, incidental, special, consequential or punitive damage, nor for any loss of profit, revenue, data, goodwill or opportunity, arising out of or in connection with the Service, whether based in contract, tort or otherwise, even if advised of the possibility of such damage. To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with the Service is limited to one hundred euros (EUR 100).

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded or limited.

14. Indemnification

You agree to indemnify and hold harmless Hermes Media against any claim, demand, loss, liability or reasonable expense (including legal fees) brought by a third party and arising from Your Content, from your use of the Service in breach of these Terms, or from your violation of any law or third-party right.

15. Privacy

Our handling of personal data is described in the Privacy Policy, which forms part of these Terms.

16. Changes to these Terms

We may amend these Terms. The revised version is published on this page with an updated “Last updated” date, and, where the change is material and affects a connected account holder, we give notice by email to the address associated with the connection at least fifteen (15) days before it takes effect. Continued use of the Service after the effective date constitutes acceptance. If you do not accept a change, stop using the Service and disconnect any connected account.

17. Governing law and disputes

These Terms are governed by French law, without regard to conflict-of-law rules. Any dispute relating to their validity, interpretation or performance falls within the exclusive jurisdiction of the competent French courts.

If you are a consumer resident in the European Union, this choice does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and you retain the right to bring proceedings before the courts of that country. Before any legal action, we encourage you to write to [email protected] so that we may attempt to resolve the matter amicably. Consumers in the European Union may also use the European Commission’s online dispute resolution platform.

18. General

If any provision of these Terms is held invalid or unenforceable, it is severed and the remaining provisions continue in full force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them in connection with a transfer of the publication. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Hermes Media regarding the Service and supersede any earlier version.
